FAQs Related To Reproduction & Copyright Topics

Question: Is it legal to buy and use a backup copy of software I already own?

Answer: No. The Copyright Act does not permit anyone to sell backup copies to third parties separately from the original copy of the software.

Question: Do I need a license to sample a track?

Answer: "Yes, you must obtain a clearance, or copyright license, for every sample that you use in your recordings. You can get a license from the copyright owner directly and negotiate a fee. Also, because both the composition and the sound recording are used in a sample track, you must obtain two clearances: one from the owner of the copyright in the song, and one from the owner of the rights to the sound recording. Sometimes this may not be the same person or company."

Question: May I register more than one work on the same application?

Answer: You may register unpublished works as a collection on one application with one title for the entire collection if certain conditions are met.

Question: Will my Cataloging In Publication (CIP) copy fulfill my mandatory deposit obligation?

Answer: No. CIP is a separate program within the Library of Congress that requires participating publishers to submit one copy of published works. The CIP is in addition to the two copies required for mandatory deposit.
